Finding Experienced Appeals Lawyers

By Cathy Seiler In the United States court of law, if a person or party is involved in litigation or legal action, and is dissatisfied with the verdict or result from that litigation, they have the right to 'appeal' that decision to a higher court. An appeal is a challenge, or dispute, of the original verdict. Because an appeal case is very different than a typical court case, and because the appeals process needs to follow a very specific protocol, finding experienced appeals lawyers to handle the case is very important. If a person does decide to appeal his/her case, it must be done immediately after the conviction takes place. The appeal itself is a written document that lets the higher court know that the defendant will be appealing his/her conviction. If an appeal is not entered immediately, or if the notice is not filed, the defendant may not be able to file an appeal at a later date. And this is why appeals lawyers are so important. The appeals process differs from a normal trial in several ways. The judge will question each of the appeals lawyers about the brief, and may allow a short time for oral arguments. In an appeal hearing, there are typically many referrals to precedents set in other trials and court cases. Because of the strict steps and protocol that are demanded in an appeals case, having experienced appeals lawyers who have dealt with them before can increase your chance of success. These lawyers have experience with appeals and finding problems or mistakes with the original trial that can be used as the basis for an appeal. They are familiar with arguing on precedents set in other cases. The appeals process is very lengthy, so both parties should be prepared in terms of time and cost. Finding appeals lawyers with experience is often done by referrals and word of mouth. Ask friends, co-workers, business professionals, or other lawyers. Public interest groups and non-profit groups may also give suggestions. Most State Bar Associations provide lawyer referral services that can give a list of appeals lawyers in your area who are available for consultation. Appeals lawyers usually charge a small amount of money for initial consultations, although some may provide a free consultation. If you can't afford a lawyer, check with a local free Legal Aid agency to find out what your options are. If a party feels they have been wrongfully sentenced during a court trial, or if he or she doesn't agree with the outcome, then he or she should talk to an appeals lawyer immediately so that the lawyer can determine if there is a basis for appeal, and file the appeal notice immediately. How To Tell If Someone Is Lying

By Steven Gillman How to tell if someone is lying? Carefully. All methods of lie-detecting, including polygraph machines, are regularly fooled or used improperly, resulting in mistakes. There are a few good ways described here, but try to confirm the truth by other means as well, such as confession or investigation of the facts. You should compare behavior in the person under suspicion to their "base" behavior, if possible. In other words, if they always have shifty eyes, then this trait can't be considered as an indication of lying. On the other hand, if they are normally very calm under pressure, but start shifting in their chair after certain questions, that may indicate lying. Because all techniques fail at times, you should use several indications before assuming the person has lied. How To Tell If Someone Is Lying By Testing Responses One way to test for lying, is to measure a persons desire to avoid a subject, which will sometimes indicate dishonesty or guilt. If you think the person is lying, change the subject quickly. A lying person will often go along easily, and may even visibly relax. An innocent person is more likely to be slightly confused by the change and want to finish their thoughts. Another lie detecting technique is to suggest something that would make a guilty person feel uncomfortable and watch for a response. Suppose your wife Jane says she was at her mother's house, and you think she is lying. Rather than saying, "I'm calling your mother to verify this," you could use a subtle approach. You might say, "That reminds me, I'm going to stop by your mother's house today to fix that door for her." If your wife was lying, the idea of you seeing her mother should make her nervous. She may give you reasons why you shouldn't go there. Of course, if your relationship has reached the point where you feel the necessity to resort to these techniques, a simple lie may not be the worst of your problems. Still, sometimes you need to know, so here are a few more ways to tell if someone is lying. They are using your words. Using your exact words to respond can be an indication of lying. You say, for example, "Did you leave this here?" and they respond, "No, I did not leave this here." They use un-contracted words. A lack of contractions is more common when lying. For example, instead of saying "I didn't sleep with her," a man might say," I did not have sexual relations with that woman." Again, compare to base behavior, though, as some people may not use contractions often anyhow. Over-compensation. Often when people lie, they try too hard to be natural, and they give more detail than is necessary. Forced smiles. A real smile involves more muscles, while a forced smile will use just the muscles around the mouth. The lie here may only be about their feelings, of course. Let them talk. The more a person talks, the more likely you are to catch them in a lie (if they are being dishonest), especially when you learn the indications to watch for. Competitor Analysis in Business - Who are Your Competitors Anyway?

By George Dennis Most companies analyzing their competition focus only on the competitor they sell directly against; usually the archrival who brings the same product to the same customer as you, leading to the death spiral of price competition. Yet there are five other competitor types you might never see in the customers office, but their effects are felt every day. Advance knowledge of who these other competitors are prevents your company from being blind sided by the same events that can demolish other companies in your business. Go ahead. Try to put a name to each of the types. The pain should start about the third one. First theres the Look-alike competitor. They do exactly what you do for the same set of customers. These are the top of mind companies your sales people watch on a minute-by-minute basis. These are also the companies sales forces are most concerned about because the customer always uses them as a point of comparison. As a result of product management pressure from one side and sales force demand from the other, marketers spend most of their time responding to the actions of the look-alike set. Write down the names of your look alike competitors. The Extensive competitor could do what your company does, if only it chose to. Extensives have the resources and expertise to move into your market but instead are listening to Sun Tzu and avoiding direct confrontation with a rival. No, the Extesnsive competitor serves a different market for the same type product. Cadillac doesnt make tiny econo-box cars, but they have all they need to so anytime. They meet their financial goals but essentially without provoking a response from companies that do make econo-cars. It might take some head scratching but you can probably come up with one or two companies to fit this profile. The Innovative competitor spells real trouble. These are the companies that completely change the rules of your market overnight. Barnes and Noble discounted Amazon.com because they saw them as just another look-alike. Since both buy books from the same printers Barnes and Noble knew that the online upstart wouldnt get a much of a better price, if at all. But Amazon was really competing on innovation in logistics- book shopping in bunny slippers. Barnes missed this one completely and took more than a year to their online store up and running. In the late 70sXerox dominated the copier market. Xerox main selling point was its huge field service force and distributed parts warehouses that guaranteed no copier would be down for more than four hours. Sharp entered the market with copiers that made four times as many impressions before needing service at all, using innovation to take away Xeroxs prime advantage. In order to monitor the innovative competitor, look to sources within the scientific community, or university research projects (and the companies funding them.) As a mental exercise, imagine waking up tomorrow and your product is obsolete. What has replaced it? Better think about who is developing it, because if it isnt you it is someone else. There are three other types of competitor often missed by both startups and market leaders. Even though they dont sell products to the your customer base their actions enhance or impede the success of your company. Resource competitors use the same materials and talent as you do, but offer different products to a different market. They have nothing to do with your business other than demanding the same supplies. But the stock Java programmers, oil, genetic material, frozen peas and lumber are limited, therefore consumers of these resources are de facto competitors. A few years ago IBM Global services, Accenture and a few other large systems integration firms announced their hiring plans for new computer science graduates. The total was 10,000 more than every graduating computer science major in the entire country. A product manager at a small company planning on two new grads for a major project would have a hard time meeting the salary and benefit demand of the scarce resource of computer science grads. Purchasing and HR departments have their fingers on the pulse of supplies and resources. Too bad they are rarely invited to strategic planning meetings. The Regulatory competitor has the force of law to make or break your next strategy. These can be approval agencies, the Food and Drug Administration for example, or a watchdog like the Environmental Protection Agency and its state equivalents. Participation in an industry trade association that maintains a lobbying presence is the best way to anticipate regulatory changes, or, better yet, encourage them in favor of your strategy rather than someone elses. Finally, theres the Political competitor. This entity doesnt have the force of law most times, but can have public opinion on its side. Labor unions, technical standards organizations and environmental activists fit this category. The motto here is if you cant control em, join em. Theres no law against working for a big oil company and joining Greenpeace to keep tabs on what the club is up to. Simple awareness of the spectrum of competitors beyond the simple look alike, already extends your companys radar over the horizon. Its not too far a leap to figure what you can do anticipate, or even influence, their impact and their effect on your business. So even though doctors have the best intentions, they have little economic incentive to spend time double checking their instincts, and hospitals have little incentive to give them the tools to do so. Try writing down on a piece of paper what you want and maybe pronounciation problems can be avoided. But other names are not the same. So, for example, cough medicine is Hustensyrop - pronounced Hoo-sten-soo-rop. Franchise Agreements Addressing Issues of Owner Participation and Franchise Training

By Lance Winslow Some franchise agreements require that the franchisee must also participate full time in the franchised business operation. Or in some cases the franchisor may employ managers to run the franchised business operation provided they have completed the franchisor's training course. Generally the franchisor will train both the owner and the owners manager during the initial training as per be confidential operations manual and stipulations into franchise agreements. In our franchise company I decided to further elaborate on this theme and therefore added clauses to our franchise agreement to address this very issue. Below you will find a copy of those clauses; 3.3 Owner Participation If Franchisee is an individual, Franchisee must devote his full time and best efforts to the day to day operation of the Franchised Business with no operational or management commitments in other businesses except other franchises offered by Franchisor. If Franchisee is a partnership, corporation, limited liability company or other legal entity, then Franchisee must designate a principal of the Franchisee who will devote his full time and best efforts to the day to day operation of the Franchised Business. Notwithstanding the foregoing, Franchisee may continue to operate such other business(es) in which Franchisee is engaged as if the date hereof, which business(es) (if any) is/are family owned. In the event Franchisee does continue to operate such other business(es), Franchisee will employ separate personnel for the same, market such services under one or more trading designations separate from the Marks, maintain separate offices and customer reception space (although such space may be located on the premises at the Location), and have the personnel related to such other business(es) wear apparel that does not feature any of the Marks. Notwithstanding the above, to the extent that any business in which Franchisee is engaged provides: (1) cleaning, washing and waxing of automobiles: or (2) Advisory Services, Franchisee shall be permitted to continue to operate such business only for a period of one hundred eighty (180) calendar days from the date thereof; but thereafter, if Franchisee has not disposed of its interest in such business, Franchisor shall have the immediate right to terminate this Agreement. 3.4 Managers; Training No matter what form of business Franchisee decides to use, the person assigned to running the day to day operations of the business must have completed the initial training course. By Tami Close Im always so in awe of the synchronicity of things. When we let things happen as God intended and not try to put our energy on the outcome or how things are supposed to show up, we let the Universe do its wonderful job in providing all the things to move us forward with our mission here on earth. We then have signs that illustrate that everything is aligned as it should be. This past week I attended an Emmanuel Apostolic Church and what an experience I had. For several years now, I had felt a pull towards this church but didnt know why. I kept thinking I have to visit this church, but then never took the action steps toward attending it. Let me tell you about my experience. Upon arriving as a new person, I am greeted with such a warmth and love that it filled me with tears. I am then given a program and I notice the picture of the Eagle which is on the program. I asked the pastors wife if the Eagle is always on the cover of the program and she said, No, we change it every week. I open the program and it illustrates their celebration of Black History Month and the topic for that day was health. I said a little prayer to God thanking Him for guiding me here. What does all this mean? The Eagle is my guide and has a huge significance for me. Ive written about the Eagle in my book, Wake UpLive the Life You Love Finding Personal Freedom. Within the past week I was visiting a friend and there were two Eagles in their nest just outside her house. On the way home, I saw two Eagles flying within a few miles of each other. I then drive up my street and my neighbor had her binoculars out looking at the tree by our respective houses with an Eagle sitting in the nest. Incredible, right? As I listened to the speakers at the church, there was no doubt in my mind why I was there. The speakers discussed health and the illnesses that plague African Americans disproportionately as compared to other ethnic groups. The statistics they quoted were quite alarming. They mentioned heart disease, cancer, stroke, diabetes, high blood pressure and obesity. The speakers told the congregation that lifestyle changes are necessary in order to become intentional in creating vibrant health. You can imagine how I was feeling at this time and why I was there. For years, Ive visualized me speaking to the masses about health. Here was an opportunity to help this group overcome their adverse statistics and paint a different picture for them. I like the phrase, Go BIG, or go home! I did meet with the pastor and told him my intent and how I was going to help his congregation. He looked at me in awe when I presented him with this information as he mentioned that prior to our meeting he spoke with three of his parishioners expressing the need for better nutrition and health. Synchronicity? Absolutely! Do I know all the details of how this is going to be accomplished? No, I dont. I just know that Im supposed to do it and the resources and the people will show up. I know it! What does this mean for you? You have a mission to complete on this earth. When you are out of balance with your health, youre so focused on not feeling good that it distracts you from your God-given assignment. You must become intentional about your health. I remember what I wrote down years ago after reading Mark Victor Hansen and Jack Canfields book, Dare to Win. In this book, you are asked to write down your objective in life and heres what I wrote: My purpose in life is to empower all people to teach them about health issues to realize they are responsible for their own well-being. I wrote this down after I had gotten myself well from an illness where I was bedridden. I went through that experience so I would understand what it feels like to have poor health and then to align myself with everything that was going to help me get well. Then years later I gained weight and lost it using all the components of my weight loss program, including the products from Isagenix. Poor health and being overweight is not where God intends us to be. Let me help guide you to better health. It is possible to feel enthusiasm for life. Low Carbohydrate Diet Revolution -- A History

By Elleth Faewen Most people think of the Atkins diet when they hear the phrase low-carb. Indeed, Dr. Robert C. Atkins is the author of a number of low carbohydrate ketogenic diet books. The first one was published in 1972, and his pioneering efforts revolutionized the dieting world we see today. For everything that you hear; however, Dr. Atkins did not create low-carb dieting. William Banting published pamphlets in the 1860s extolling the health benefits of the low carbohydrate diet he was put on by his medical advisor, Mr. William Harvey, F.R.C.S. The basic tenet of his diet was to consume as little as possible bread, butter, milk, sugar, beer, and potatoes due to his belief that these contained starch and saccharine matter, which tended to create fat. Mr. Banting found that his indigestion disappeared, his umbilical rupture was cured, he lost 50 lbs, his sight and hearing were surprising for a man in his 70s, he slept better at night, and he basically felt in better health than he had for the previous 26 years of his life. Mr. Banting revolutionized dieting in his time, and he received thousands of letters from readers thanking him and telling him how his low carbohydrate diet had changed their lives for the better. The Johns Hopkins University and Mayo Clinic devised a diet to treat epilepsy in the 1920s. The diet requires high fat consumption and a low intake of carbohydrates in order to induce ketosis. They studied how the diet worked with children who were unsuccessful in treating their epilepsy with medication, and they found that 55 percent of the original patients remained on the diet and 27 percent had a greater than 90 percent decrease in their seizures. There were some children who had no seizures for two years while on the diet, and they appeared to be cured of the epilepsy even after stopping their low-carb ketogenic diet. Walter Lyons Bloom and Gordon Azar did a study in 1963 comparing carbohydrate restrictive diets to fasting diets. They concluded that eating a diet adequate in calories, protein and fat, but deficient in carbohydrate, resulted in weight loss similar to that of fasting patients. The first truly popular low-carb diet was popularized in the book The Doctors Quick Weight Loss Diet by Dr. Irwin Maxwell Stillman in 1967, and the low carbohydrate revolution began. The diet consisted primarily of protein sources like meat, fowl, fish and eggs while curtailing the consumption of carbohydrates to close to nothing. The book sold 2.5 million copies from 1967-69 and large numbers of people lost a lot of weight on this controlled carbohydrate diet. Dr. Robert C. Atkins opened his practice as a cardiologist in New York City in 1960. When he was in his 30s and overweight, he ran across a 1963 article by Bloom and Azar. Their article said you do not have to go hungry to lose weight; instead, you can lose weight by cutting back on carbohydrates. This convinced Dr. Atkins to try the diet, and to his amazement it worked very well. After his success with the diet, he began recommending it to his patients and found that not only did they lose weight; other health problems they were fighting with either had greatly improved symptoms or went away completely. These included high blood pressure, elevated cholesterol levels, heartburn, diabetes, acid reflux, and arthritis. The vast majority of his patients also reported that they slept better, had more energy, got sick less often, and basically felt better overall. Dr. Atkins published his original book, Dr. Atkins Diet Revolution, in 1972; however, the revolution was off to a slow start. His low carbohydrate diet countervailed what had been taught in the mainstream medical institutions and was attacked by the likes of nutritionists, dieticians, physicians, and the Journal of the American Medical Association; however, other doctors were also now aware of the connection between carbohydrates, disease and obesity. In 1983 Dr. Richard Bernstein, a type 1 diabetic since the age of nine, opened his highly controversial clinic to treat diabetics with a very strict low carbohydrate approach to the disease. Bernsteins ideas were ridiculed at first by the medical establishment, but the low-carb revolution picked up steam. In 1992, Dr. Richard Heller wrote his first diet program called The Carbohydrates Addicts Program for Success: Taking Control of Your Life and Your Weight, which blamed high carbohydrate consumption for the increased obesity being found throughout the USA. He found a fast growing audience for his ideas as the revolution continued to grow. The first edition of Dr. Atkins New Diet Revolution was published in 1992, and another came in 1999. These two editions sold over 10 million copies and the editions combined to become one of the 50 top selling books of all time. The year 1999 was a breakthrough year for low-carb practitioners and the low-carb revolution steamed full speed ahead. Dr. Richard Bernstein published his book Diabetes Solution, and it was an instant hit selling upwards of a million copies. Today the latest 2003 Edition has a preface by none other than the president of the American Diabetic Society, quite a victory for a man who when he first preached his controlled carbohydrate approach to the disease was regarded as a crackpot and eccentric by the American Medical Association. Also in 1999, Dr. Richard Heller teamed up with his wife, Dr. Rachel Heller and Dr. Frederic Vagnini to publish The Carbohydrate Addict's Healthy Heart Program: Break Your Carbo-Insulin Connection to Heart Disease, a newer version of his first book that documented very clearly the relationship between high carbohydrate consumption and the plethora of Syndrome X diseases as well as, of course, obesity. This book and several related ones by this group of authors sold and continue to sell millions of copies. One low-carb diet; however, was much more successful and popular with the public than the others; that was Dr. Robert Atkins diet. Literally millions of people succeeded in losing weight and improving their overall health by following the programs put forth in Dr. Atkins New Diet Revolution. Dr. Atkins nutritional approach spread primarily by word of mouth as people successful on the diet introduced it to others. The medical establishment was stubbornly against the Atkins approach and tried their best to discredit it. The debate over the Atkins nutritional plan grew into a roar as millions tried and succeeded losing weight and improving their health while the experts claimed it was wrong and could not be done. The real testament as to the validity of Dr. Atkins program is that while a large majority of the medical & nutritional establishment claimed his diet was just plain wrong, the number of people following the program continued to grow at a faster and faster pace as successful individuals motivated and encouraged their friends and others to try the Atkins Nutritional Plan. As more and more people found the diet worked for them, other successful low carbohydrate diets quickly followed such as The Zone, Sugar Busters!, The No-Grain Diet, and The South Beach Diet, to name a few. The revolution took off at amazing speed when Dr. Atkins published an updated version of his book, Dr. Atkins New Diet Revolution, in 2002. The new edition incorporated slight changes in his program based on his last 30 years of research. This edition of his book was soon followed by a plethora of published research findings validating the weight loss and health benefits of a low carbohydrate diet. Some people in the groups that previously attacked his diet were now considering the possibility that low carbohydrate consumption was a safe, effective way to lose weight and eat for life. Now millions of people are doing Atkins, and the revolution has skyrocketed. Companies have begun putting out a myriad of low carbohydrate foods, which have quite literally flown off the shelves. More and more restaurants are providing low carbohydrate menus or net carbohydrate counts on their existing menu items. Even fast food companies have jumped on the bandwagon with low carbohydrate hamburgers, wraps, and breakfast bowls. What the future holds for low carbohydrate diets is anyones guess. They have entered the mainstream, and the results of current research will certainly have a major impact on the continued acceptance of low carbohydrate diets. Don't Roll that Lawn

By Doug Green Every spring some mysterious hormone hits the male of the species and the urge to "do lawn work" strikes. One rite of spring is act of rolling the lawn. I've never been able to figure out why someone would roll a lawn; in my household, a lawn is for rolling on, not for being rolled. Many local homeowners, no doubt hormonally unbalanced by the passing of winter, like to go out and drag a heavy weight around the lawn. I recently read one newsletter that said the reason for rolling was to make sure the grass roots were in contact with the soil. Right, and I've got a bridge I can sell you. Grass roots, if properly grown, are quite deep and no amount of frost is going to throw them out of contact with the soil. The only thing rolling a lawn accomplishes is to compact the soil. Rolling the lawn compacts the soil squashing all the soil particles together. This means that air spaces necessary for good root growth are eliminated. It also means that water can't penetrate the soil because there are no holes for it to move into. The bulk of the water runs off the lawn and never penetrates deep into the soil to the root zone level. This run off water takes the dissolving plant food with it so the spring feeding is washed down the sewer. In one fell swoop, rolling a lawn eliminates the necessary aeration, prevents water from entering and assists in the removal of spring applied fertilizer. I can't think of an faster way to help put stress on a lawn than to roll the lawn first thing in the spring.
